Canadian Courts: Estranged Wife Deserves Half of Lottery Winnings10 May 2002BRITISH COLUMBIA – As reported by the National Post: "A British Columbia judge has ordered an elderly man to pay his estranged wife half of the lottery he won four years ago -- even though the couple was separated when he hit the jackpot. "Madam Justice Catherine Wedge of the B.C. Supreme Court said although Romolo Nisbet purchased the winning ticket on his own, it was part of a joint `venture' that he and his wife, Mary, began shortly after they were married in 1990. "Consequently, the judge ruled Mrs. Nisbet -- who moved back in with her husband after the win, then filed for divorce two years later -- is entitled to half the cash. "`Mary contributed directly over the years to the purchase of the lottery tickets,' the decision said. `She may not have contributed directly to the purchase of the winning ticket ... but she had contributed to the purchase of the tickets on many prior occasions.' "The Nisbets, and their close friends, Murray and Chris Begg, each contributed $20 a month to a mutual lottery fund. "…During the separation, on Dec. 12, 1998, the Nisbets and the Beggs won a draw worth $1.12-million…" |
