Appeals Court Reject Louisiana Ballot Lawsuit1 November 2002BATON ROUGE, Louisiana – As reported by the Associated Press: "An appeals court Wednesday rejected Cameron Parish's effort to bypass the Legislature and conduct a local election to get a riverboat casino. "The 1st Circuit Court of Appeals reversed state District Judge Janice Clark, agreeing with the secretary of state that the parish had no cause of action to bring suit and hold an election on Nov. 5. "State attorneys argued that the law and constitution are clear that the Legislature must take action before local voters can decide the issue. "Clark had issued an injunction forcing Secretary of State Fox McKeithen to put the riverboat issue on the Cameron ballot. "That injunction was dissolved by the appeals court. "…The appeals court panel said the constitution is clear that the Legislature has sole power to define and suppress gambling…" |
