Mississippi Judge Won't Reconsider Casino Barge Decision

BILOXI, Mississippi – As reported by the Associated Press: "A Harrison County judge on Monday refused to reconsider his ruling in August that the Mississippi Gaming Commission was wrong when it approved plans by Treasure Bay to move its casino barge to a man-made basin.

"Circuit Judge Robert H. Walker had ruled on Aug. 4 that the spot south of the Biloxi seawall is land-based and unacceptable for a casino site under state law. He reversed a Gaming Commission decision that approved the move.

"The Gaming Commission and Treasure Bay are considering an appeal to the Mississippi Supreme Court.

"Walker said the seawall is used as the boundary for locating casinos. State law limits casinos to areas along the Mississippi River or its tributaries and the coast along the Gulf of Mexico.

"…Walker had said the site sought by Treasure Bay 'is presently 100 percent land and would require dredging to allow the waters of the Mississippi Sound to flow into the area before the casino barge could be removed to it.'…"
